Connecticut probate court fees are not set by individual judges or courts. They are established by statute under Connecticut General Statutes Section 45a-107 and apply uniformly across all 54 probate districts. The fee is based on the gross value of the estate being administered.

The statutory schedule uses a tiered structure: smaller estates pay a lower percentage, and the rate decreases as estate value increases. The maximum probate fee is capped at $40,000, regardless of how large the estate may be. Estates valued at $10,000 or less pay no probate fee at all.

One significant provision benefits surviving spouses. When the surviving spouse is the sole beneficiary of the estate, the probate fee is reduced by 50%. This reduction applies automatically based on the distribution outlined in the will or, for intestate estates, under Connecticut’s laws of descent.
